1. BETA PHASE DISCLAIMER
Welcome to the BringItHome Beta. Think of this beta phase like the learner sign on a vehicle—BringItHome is already on the road and delivering value, but we're still learning, improving, and refining the experience with every mile.
During this period, you may occasionally encounter bugs, missing products, or features that are still being developed. We appreciate your patience and understanding as we continue to expand and improve the platform.
Most importantly, we're building BringItHome for you. Your feedback, suggestions, and ideas play a vital role in shaping the platform as we move toward full operational status. By operating on the platform during this beta phase, you acknowledge these conditions and agree that your feedback may be used to improve our services without any obligation or compensation to you.
2. FREELANCE CONTRACTOR RELATIONSHIP
By applying to operate on the SellMarket Platform, you agree that you are a Freelance Shopper and an independent contractor, not an employee of BringitHome Premier Solutions Limited. You are solely responsible for your taxes, insurance, and professional conduct.
Note: Employed Market Managers are governed by separate internal employment policies and are not subject to this agreement.
3. FEES AND PAYOUTS
- You receive 100% of the prices you charge in your accepted offers. BringItHome adds a service charge on top — this is paid by the Buyer and covers all payment processing (PSP) fees.
- Payouts are processed typically within 1–2 business days after the Buyer's 1-hour dispute window has elapsed and your payout has been released by BringItHome's finance system. Settlement timelines are also subject to Paystack's current policies.
- BVN verification and a valid registered bank account are required before any payout can be processed. This is a mandatory CBN compliance requirement.
4. RIDER LIABILITY & CONSENT
You are solely responsible for procuring and managing any delivery riders you use. You bear all liability for the actions of your riders. You guarantee that you have obtained explicit consent from any rider you dispatch to share their name and phone number with BringItHome and the assigned Buyer for the purpose of delivery coordination.
5. PERFORMANCE, LATENESS & UNREACHABLE BUYER POLICY
Your platform ranking is based on buyer ratings, order completion rate, and adherence to your stated delivery ETA. Late deliveries may result in platform penalties including payout deductions or temporary suspension.
Unreachable Buyer Warning: If your dispatched rider cannot reach the Buyer upon arrival, you may trigger the "Buyer Unreachable" warning in the app. This pauses your delivery timer while the Buyer is contacted. This feature is rate-limited — you may only trigger it after a minimum waiting interval and a maximum number of times per delivery (as configured and displayed in the app at the time of triggering).
⚠️ FRAUD WARNING: Triggering this warning falsely — for example, to evade a lateness penalty when you have not yet dispatched a rider — is considered fraud against the platform and the Buyer. This will result in immediate account suspension, significant payout penalty deductions, potential permanent ban, and referral to law enforcement agencies.
6. DATA PROCESSING AGREEMENT (NDPA 2023)
As a Freelance Shopper, you act as a Data Processor under the Nigeria Data Protection Act 2023. By using this platform, you agree to:
- Handle Buyer personal data (names, delivery addresses, phone numbers) strictly for the purpose of fulfilling the specific order.
- Not store, share, sell, screenshot, or use Buyer data for any marketing, solicitation, or unauthorized purpose.
- Delete or destroy any Buyer personal data in your possession upon completion of the order.
- Report any accidental data breach or unauthorized disclosure to privacy@bringithome.ng immediately.
Any breach of this Data Processing Agreement will result in immediate account termination and reporting to the Nigeria Data Protection Commission (NDPC).
7. PUBLIC DATA DISPLAY
By registering on the platform, you consent to your username, avatar, market specialisation, rating score, and aggregate performance metrics being displayed publicly to Buyers as part of the core marketplace service.
8. ACCOUNT STANDING, SUSPENSION & APPEALS
- Warnings: Minor infractions result in an in-app warning. Repeated warnings may escalate to suspension.
- Temporary Suspension: A suspended account cannot receive or accept new orders for the duration of the suspension period.
- Pending Payouts: Payouts in settlement cycles at the time of suspension will not be withheld unless the suspension relates to suspected fraud on the specific transaction.
- Right to Appeal: You may appeal any suspension or penalty by emailing legal@bringithome.ng within 14 days of the action. We will respond within 7 business days.
- Permanent Ban: Any wallet balances will be settled within 30 days unless the ban relates to fraud or a legal hold.
9. LIMITATION OF LIABILITY & INDEMNITY
BringItHome's total liability to you as a Shopper for any claim arising from your use of the platform shall not exceed the payout value of the specific order giving rise to the claim. BringItHome is not liable for any loss of income, opportunity, or consequential loss arising from platform downtime, order cancellations, or buyer disputes.
10. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from your use of the SellMarket platform shall first be referred to BringItHome's internal dispute resolution process via legal@bringithome.ng . If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Delta State, Nigeria .
